Quick Copyright Question:

Does anyone know the answer to this?

I want to use a particular song in a photo montage.  It's by a big artist and I would be putting the song info in the video (if I can do it).

The video will just consist of some of my own photos and the song.  

However, if this is a big NO NO I won't do it.  I know I've seen it done before but I want to make sure I'm following rules.  I haven't been able to find any info on You Tube about it.

In the USA it would definitely be illegal. Youtube would probably disable the audio if they found out, but there are a lot of songs you could use. Public domain songs, I mean, which are not copyrighted. You'd have to look into that. The only way something can be public domain is if the artist requested it or if the last copyright holder has been dead for 50 years (and they didn't pass it down to anyone etc)

So basically something like classical music would probably be fine, but something by Madonna would be very much not fine. Unless it wasn't going to be put up online, if it was for personal use you could have ANY song. (Like facebook that is friend-locked.)

That's pretty much what I figured. I've decided to forget the whole thing. I just heard a song that I really liked and I could imagine some of my photos working with it and thought it might be fun to try it, but I've scrapped the idea.

I even tried to find some public domain songs to use, but I felt like I was looking for a needle in a haystack so I gave up! LOL!

Here's something to think about... if someone took your picture to put a song to it without asking you, would that be breaking copyright? Would you be a bit miffed? There's never any harm in asking :)

I THINK that it's a case of if you don't have the permission of the artist you are in breach of copyright. I know that DJ's in the UK have to have some sort of copyright license, but I'm not sure what it does or anything, just that my friend is a DJ and has a license. I know some other places too that have them. So I'd be careful with it hun.

yeah, that's basically what I was thinking..... I think I'll just scrap the whole idea. It's not worth the hassle to try to get permission, etc.

See if you can find a local band that would be willing to let you use their work - I'm sure they'd appreciate the publicity :)

I kind of wondered that too. I think some songs on youtube have had their sound disabled so it might be a no but I am not sure.

As far as I know, if you're not making any profit or being derogtory, I can't see what they can do. Is the montage for yourself, or to be broadcast to a potentially paying audience?
